Government agencies committed irregularities in setting recruitment quota for teachers: Allahabad HC

The court directed the state government to revise the final list issued in this regard on June 1, 2020, within the next three months after duly validating the notice.

The Lucknow bench of the Allahabad High Court on Monday alleged that the authorities committed several irregularities while fixing the quota for appointment of 69,000 assistant teachers in Uttar Pradesh’s Assistant Teacher Recruitment Examination (ATRE)-2019.

The court directed the state government to revise the final list issued in this regard on June 1, 2020, within the next three months after duly validating the notice.

Also, the board canceled the select list of 68,000 teachers issued on January 5, 2022.

“The reservation limit should not exceed 50 per cent of the total seats in any case,” the bench said.

The bench of Om Prakash Shukla passed judgment on 117 writ petitions.

“Of course, the scores and details of the reserve category candidates who appeared in ATRE 2019 were not clear. There has been no attempt by government agencies to maintain and facilitate ATRE 2019 records. the court is securing the said records,” Justice Shukla said in the order.

“Candidates who have been appointed and are currently working as assistant teachers in various districts under ATRE 2019 will continue to serve until the government authorities revise the selection list,” he said.

The court also sympathized with the teachers who were dismissed as a result of the review, but ruled that the order would work to restore equity.

“The state authorities have a constitutional duty to implement the provisions of the Law on Control in its content and spirit.

“However, this court is not exactly designed to mete out justice and remember the young men and women who will shape the future of this country as teachers,” the court said.

It has given freedom to the state government to formulate a policy to adjust the teachers who may be dismissed through the revision in the select list on June 1, 2020.

After hearing a number of applications, the board had to check the correctness of the quota given by the state authorities for the appointment of 69,000 teachers, as well as the legality of the appointment of 68,000 teachers who exceeded the published limit of 69,000 vacancies.

Earlier, the bench dismissed the arguments of senior advocate Sanjay Bhasin, assisted by additional senior standing advocate Ran Vijay Singh, who unsuccessfully tried to defend the action of the state authorities.
